This Privacy Policy describes how EVDC Networks LLC (operating as "evdc.network", the “Site”, “we”, “us”, or “our”) collects, uses, processes, and discloses your Personal Information when you visit, interact with, make a purchase from, or use the electric vehicle charging services provided via the Site or our associated applications.

1. COLLECTION OF PERSONAL INFORMATION

We collect information that identifies, relates to, describes, or could reasonably be linked, directly or indirectly, with a specific consumer or device (“Personal Information”). We collect different categories of Personal Information depending on how you interact with our Services.

A.Device & Usage Information

Specific Data Collected: Web browser version, IP address, device type, operating system, time zone, geolocation data, cookie identifiers, unique device tokens, pages or products viewed, search terms, and behavioural interaction metrics with our Site.

Purpose of Collection: To optimize and accurately load the Site, prevent fraud, secure our network, and perform internal analytics to improve our user experience.

Source of Collection: Collected automatically when you access our Site or mobile app using cookies, log files, web beacons, tags, and pixels.

Disclosure for a Business Purpose: Shared with our primary e-commerce processor, Shopify, and our cloud-hosting, security, and analytics partners.

B. Order & Billing Information

Specific Data Collected: First and last name, billing address, shipping address, payment information (including encrypted credit/debit card numbers, digital wallet tokens, or cryptocurrency addresses used for transaction processing), email address, and phone number.

Purpose of Collection: To fulfill our contractual obligations to you (processing payments, facilitating order fulfillment/shipping, issuing invoices and order confirmations), communicating directly with you, screening transactions for potential fraud or credit risk, and delivering targeted marketing in accordance with your communication preferences.

Source of Collection: Provided directly by you at the time of purchase or account creation.

Disclosure for a Business Purpose: Shared with Shopify, integrated payment gateways, fulfillment applications, and shipping couriers.

C. Customer Support Information

Specific Data Collected: Communication history, support tickets, and any additional files, images, or contextual data you voluntarily provide to resolve your inquiry.

Purpose of Collection: To provide timely, high-quality customer support and technical troubleshooting.

Source of Collection: Provided directly by you when initiating support requests.

Disclosure for a Business Purpose: Shared with integrated customer relationship management (CRM) software and support ticketing systems.

2. MINORS & CHILDREN'S PRIVACY

The Site and our Services are strictly intended for individuals who are at least 18 years of age (or the age of majority in their jurisdiction). We do not knowingly or intentionally collect Personal Information from children under the age of 16.

If you are a parent or legal guardian and believe that your child has provided us with Personal Information, please get in touch with us immediately at hold@evdc.network to request deletion.

3. SHARING & DISCLOSURE OF PERSONAL INFORMATION

We share your Personal Information with trusted third-party service providers (processors) who perform operational tasks on our behalf, including:

Shopify: We utilize Shopify to power our online store and processing infrastructure. You can read more about how Shopify uses your Personal Information here.

Legal Compliance & Security: We may disclose your Personal Information without your consent to comply with applicable laws and regulations, respond to a subpoena, search warrant, court order, or other lawful requests for information we receive, or to protect our legal rights, property, and the safety of our users.

4. BEHAVIORAL ADVERTISING & REMARKETING

We use your Personal Information to provide you with tailored, targeted advertisements or marketing communications we believe may be of interest to you.

Google Analytics: We use Google Analytics to analyze how visitors interact with our Site. You can read more about Google's data usage here. You may opt out of Google Analytics processing by installing the opt-out browser add-on here.

Ad Partners: We may share details about your site interactions and purchase history with advertising networks (such as Google Ads, Microsoft/Bing Ads, and Meta/Facebook) to serve personalized advertisements to you on other websites.

5. LEGAL BASES FOR PROCESSING (EEA/UK RESIDENTS)

Pursuant to the General Data Protection Regulation (“GDPR”) and the UK Data Protection Act 2018, if you are a resident of the European Economic Area (“EEA”) or the United Kingdom, we process your Personal Information under the following explicit lawful bases:

Your Explicit Consent: Where you have granted clear consent for specific processing activities (e.g., subscribing to newsletter communications).

Contractual Necessity: Where processing is required to execute or fulfill a contract directly with you (e.g., billing, charging session processing, and shipping).

Legal Obligation: Where processing is necessary for compliance with a legal or regulatory obligation to which we are subject.

Vital Interests: To protect your vital interests or those of another physical person in an emergency.

Legitimate Interests: For our legitimate business interests (e.g., detecting and preventing fraud, maintaining network security, and optimizing our site) where these interests do not override your fundamental rights and freedoms.

6. RETENTION OF DATA

When you place an order, create an account, or complete a transaction through the Site, we will retain your Personal Information in our active databases for our business and legal records. We store this data unless and until you submit a valid request to erase this information (subject to legal retention mandates, tax requirements, and anti-fraud purposes).

7. AUTOMATED DECISION-MAKING & PROFILING

We do not engage in fully automated decision-making (including profiling) that carries a legal or otherwise significant effect on you using customer data.

Our core processor, Shopify, utilizes limited, automated system security parameters to prevent payment fraud. These safety parameters do not have any legal or significant structural impact on you. These automated, temporary systems include:

Temporary IP Denylisting: Automatically blocking IP addresses associated with repeated, failed, or high-risk transaction attempts. This block persists only for a few hours.

Temporary Card Denylisting: Automatically blocking credit cards linked to repeatedly blocked IP addresses. This block persists only for a few days.

8. CALIFORNIA CONSUMER PRIVACY RIGHTS (CCPA/CPRA)

If you are a resident of California, you have specific rights under the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (“CCPA/CPRA”).

No Sale or Sharing of Personal Information: We do not "sell" your Personal Information for monetary compensation. However, we do utilize third-party cookies for advertising, which may be deemed as "sharing" under the CCPA/CPRA. You may opt out of this sharing via your browser controls.

Right to Know / Access: You have the right to request disclosure of the specific categories and pieces of Personal Information we have collected, used, and disclosed about you over the past 12 months.

Right to Correct: You have the right to request that we correct inaccurate Personal Information we maintain about you.

Right to Delete: You have the right to request the deletion of your Personal Information, subject to statutory exceptions (such as completing an ongoing transaction, compliance with legal obligations, or security auditing).

Right to Portability: You have the right to receive your data in a structured, commonly used, and machine-readable format.

Non-Discrimination: We will not discriminate against you in pricing, access, or quality of service for exercising any of your CCPA/CPRA rights.

9. EUROPEAN UNION & UK PRIVACY RIGHTS (GDPR/UK GDPR)

If you are an EEA or UK resident, you possess the following rights regarding your Personal Information:

Right of Access, Correction, and Portability: You may request access to, correction of, or a portable copy of the personal data we hold about you.

Right to Erasure ("Right to be Forgotten"): You have the right to request that your personal data be permanently erased when it is no longer necessary for the purposes for which it was collected, or if we have no overriding legal basis to keep it.

Right to Restrict or Object to Processing: You may restrict or object to our processing of your data under certain conditions (e.g., for direct marketing purposes).

International Data Transfers: Your Personal Information will be initially processed in Ireland by Shopify and will subsequently be transferred outside of Europe for storage, backup, and advanced processing, primarily to Canada and the United States.
